Is Child Custody For Fathers A Realistic Aim?

Child custody for fathers is one of the most difficult arrangements to obtain in a society which nominally awards custody based on the best interests of the children, yet which statistics prove is biased almost to the point of obsession with awarding child custody to mothers. The child support system is even more incredibly biased in the way it operates, largely because there are organizations with vested interests who are mitigating against the successful working of a system which is of dubious value in the first place. This is a very bad time in history to be a father, but there are some steps you can take to combat the worst excesses.

The most obvious way of preventing these problems is to keep your marriage together and working well, but every realist knows this is something over which you only have partial control. While marriage is functioning well and everyone including the children live under the same roof the courts will not intervene in any support issues. It is when the marriage is breaking down and the separation about to occur that the legal system begins to take notice. Courts will assess the suitability of each parent for several roles, including that of custodial parent, so it is important to present yourself in the best possible light.

In a child custody hearing, the court will listen to the arguments from both parents as to why they should be the ones to take care of the children. Fathers have a greatly reduced chance of success according to every statistic which is ever published, and in the experience of anyone who has gone through a court system in the Western world. In the United States it is not uncommon to see fathers being denied any rights but being given plenty of obligations.

If child custody for fathers is going to be given any chance of working there will need to be conclusive proof that the father is the most suitable parent for the child to stay with, and that the child's educational future will be better safeguarded by the father. If paternity is in doubt, it will be extremely useful to prove this through DNA testing as it is far more likely that a natural biological father will be given custody. The exception to this will be if a father has been playing a significant role in the child's development over many years.

Winning the custody battle will also make the next one far easier to cope with, as millions of fathers have found that once they have been denied custody of a child they are then assessed to pay child support until the child reaches the age of majority. Many of these awards are totally out of proportion with what is needed to support the child, and they often cause genuine hardship to the father. The jails are filled with thousands of men whose only crime was to be unable to pay a child support award.

Many have taken an alternative route to child custody for fathers by moving across international borders to avoid unfair judgments, but this is far harder to do now no matter how much money you have. There are so many reciprocal arrangements in place that it is difficult to find a country where enforcement officers from the States will receive no cooperation. The only obvious ones are extremely unsafe for bringing up a child in any case. The international route has effectively been blocked off, to the detriment of wealthy fathers who hoped to avoid both unfair divorce settlements and the need for child support. Now, the courts genuinely determine child custody for fathers.
